General Hiring Terms
These General Hiring Terms apply to client requirements handled by OK MADAM. Specific written terms communicated for a requirement may supplement these terms and will apply to that engagement to the extent permitted by law.
1. Registration & Acceptance
The registration fee is ₹999 upfront. By paying the registration fee and submitting a requirement, the client confirms that they have read and understood the applicable service, payment, candidate and hiring terms. Registration starts the service relationship but does not guarantee immediate candidate availability or selection.
2. Service Validity
The client registration/service validity does not expire. The client may request new candidates whenever needed, subject to candidate availability, suitability, location, salary, timing and other applicable requirements. A new candidate request does not waive any outstanding payment or existing obligation.
3. Candidate Options & Replacement
OK MADAM may provide up to 3 suitable candidate options sequentially for a requirement, subject to availability. A maximum of 5 replacement requests may be provided within a 12-month period for an active candidate deployment/service requirement, subject to availability and compliance with these terms. Replacement does not mean an automatic guarantee of an immediate alternative candidate.
4. Paid Trial & Candidate Continuation
Where a trial is offered, it is a paid trial and the applicable trial terms will be communicated before commencement. Once a candidate is selected and starts working, the client is expected to continue the candidate through the applicable month and honour the agreed salary and service commission obligations.
5. Monthly Service Commission
The service commission is an additional 10% of the candidate's salary every month while the candidate is working through the service relationship. Commission becomes payable for the period in which the candidate is working and is separate from the candidate's salary. The regular commission due date is the 1st of every month, unless a different written arrangement is communicated by the team.
6. Candidate Salary
The candidate's salary is separate from the 10% service commission. Salary must be paid directly according to the salary cycle and due date mutually agreed between the client and candidate. The client must not intentionally delay, withhold or improperly deduct salary. Salary disputes should be reported to OK MADAM promptly.
7. Payment Default, Blacklisting & Legal Remedies
Failure to pay the service commission on time, failure to pay candidate salary, repeated payment delays or refusal to clear legitimate dues may lead to suspension or termination of the service, client blacklisting, withdrawal of candidate/service support, recovery of outstanding amounts and legal action where appropriate. These remedies are subject to the applicable agreement and law.
8. Client Conduct & Termination Rights
OK MADAM reserves the right to suspend or terminate a client's subscription/service if there is client or household misbehaviour, harassment, abusive conduct, unsafe working conditions, untimely salary payment, untimely commission payment, unauthorized multi-person handling of a candidate, misuse of candidate information, breach of confidentiality, unlawful instructions, repeated disputes created in bad faith, or any material breach of these terms. Serious cases may result in immediate termination without further service obligation, subject to applicable law.
9. One Client / One Requirement — No Transfer
The registration, subscription and service arrangement is personal to the registered client/requirement. It cannot be transferred, sold, assigned or shifted from one client name to another, and it cannot be transferred from one city to another. Any change of client, employer, household or city requires prior communication with the OK MADAM team and may require fresh registration, commission, travel or other applicable charges.
10. Services Outside Jamshedpur
The standard terms and charges are primarily structured for Jamshedpur. For locations outside Jamshedpur, registration, commission, travel, verification, deployment, replacement and other charges may be different and will be communicated by the team before proceeding. Outstation requirements are subject to candidate availability and written confirmation.
11. Outstation Candidate Deposit & Travel
For an outstation candidate, the client may be required to provide a deposit equivalent to one month's agreed salary. The deposit may be redeemed or adjusted at the end of the applicable tenure or when the candidate is properly returned, according to the engagement terms. The client must provide proper onward travel and a return ticket for the candidate where applicable. Travel expenses are separate from the service commission.
12. Hold / Pause / Close Service
The client may request to hold, pause or close the service at any time by informing OK MADAM. If a requirement is placed on hold, the candidate must not remain at the client's premises unless continued work is expressly agreed with OK MADAM and the applicable payments remain current. Keeping a candidate at the client's premises while claiming the requirement is on hold may be treated as a breach of these terms.
13. No Direct Hiring Outside OK MADAM
A client must not directly hire, engage, transfer or continue employing any candidate introduced, referred or shared through OK MADAM outside OK MADAM's knowledge and service arrangement in order to avoid the applicable commission or service terms. Any such conduct may result in termination, blacklisting, recovery of applicable service dues and legal action where appropriate.
14. Verification, PVR & Background Checks
Candidate verification may include identity, address, police verification (PVR) and background checks through applicable processes. The verification charge is ₹1,500 per candidate, unless a different written charge is communicated. Verification is a due-diligence measure and does not guarantee future conduct, attendance, performance, medical fitness or suitability.
15. Candidate Availability & Deployment
Deployment depends on candidate availability, skills, experience, salary compatibility, location, interview/trial, verification, relocation willingness, client response and market conditions. Festivals, holidays, travel, candidate withdrawal, illness and other events may affect timelines. Any estimated timeline is an operational indication and not an unconditional guarantee.
16. Client Responsibilities
The client must provide lawful and safe working conditions, timely salary, appropriate food, restroom and accommodation where applicable, reasonable duties and working hours, and a respectful workplace. Harassment, abuse, forced labour, unlawful discrimination, unsafe conditions or unlawful instructions are prohibited.
17. False Allegations, Reviews & Defamation
Clients are free to raise genuine complaints through the appropriate support channel. However, knowingly false, fabricated, malicious or misleading allegations published against OK MADAM, its management, staff or candidates on Google or other public resources may be treated as a serious breach and may result in appropriate complaint, evidence-based response, takedown request or legal remedy, including defamation proceedings where the facts and applicable law support such action. Clients should first provide an opportunity for genuine grievances to be reviewed and resolved.
18. No Automatic Refund Assumption
Clients should pay the registration fee only after understanding the applicable terms. Payment of the registration fee confirms acceptance of the registration process and does not by itself create a guaranteed deployment or an automatic refund entitlement. Any refund, adjustment or replacement will be governed by the specific written terms applicable to the requirement and applicable law.
19. Privacy & Confidentiality
Client and candidate information must be handled confidentially and only for legitimate service purposes. A client must not publish, circulate or misuse candidate personal information or documents. OK MADAM may use submitted information for requirement processing, candidate coordination, verification, communication and service administration.
20. Intellectual Property & Copyright
OK MADAM branding, website text, design, original graphics, service descriptions and other original material are protected to the extent permitted by applicable intellectual-property law. No content may be copied, reproduced, republished or commercially reused without written permission.
21. Brand & Management
OK MADAM is the service brand. Management and copyright attribution: NHTPL Management Consultant.
22. Governing Law
These terms are intended to operate under applicable Indian law. Specific contractual disputes will be addressed according to the applicable written engagement documentation and competent jurisdiction, subject to applicable law.
23. Changes to General Terms
OK MADAM may update its general hiring terms, service categories, charges and operating policies from time to time. The terms applicable to an accepted requirement will be determined by the written terms communicated for that engagement.
